We're proposing an update to our parking legislation, including allowances for electronic parking technology and changes to penalties, and invite your feedback.


Under the Local Government Act, we’re required to periodically review local laws to ensure their currency.

In 2019 the City advertised its intent to review the Parking Local Law 2006, and invited the community to provide feedback over a period of six weeks. Since then, officers have completed a comprehensive review of the parking local law and have recommended adopting a new law in its place, which is now advertised for public comment.

The purpose of the proposed local law is to enable the City to regulate the parking of vehicles within the district and provide for the management and operation of parking facilities under the City’s care, control and management.

The effect of the proposed local law is that a person parking a vehicle within the parking region is to comply with the provisions of the local law.


What are the proposed changes?

  • The City has not changed its infringement amounts in eight years and the new law recommends increases to some penalties. To view a full list of the proposed changes to penalties, click here.
  • Provisions to allow the adoption of electronic parking technology, including provisions which will allow the City to set 'Pay by Phone only' zones.
  • Provisions to allow for electronic parking permits.
  • New provisions for parking at construction sites.
  • An amendment to help prevent free parking from being exploited.
  • An amendment regarding verge parking including for trailers, caravans or boats.
  • An amendment to allow motorcycles to be parked in any bay, given the fee is paid.
  • Other amendments to remove repetition and streamline requirements of current legislation.

    The proposed Parking Local Law 2021 (as amended) was approved by Council on 28 July 2021 and will be Gazetted. They also requested that the implementation of ‘pay-by-phone only’ zones is considered in circumstances where the implementation of parking ticket machines is found to be prohibitive due to cost or technical issues or physical or other constraints.     In response to feedback received at the June Finance, Policy, Operations and Legislation (FPOL) Committee meeting, a proposed amendment to the verges clause (5.18) will now be presented for consideration.

    The proposed Parking Local Law 2021 (with amendments) will be considered for adoption at the FPOL committee meeting on Wednesday 14 July 2021. Subject to the decision at FPOL it will then be considered at the Ordinary Council meeting on 28 July 2021.

    At the meeting of 9 June 2021, Committee voted to defer this item to allow officers to seek further legal advice on several matters. It is expected to be considered at the next Finance, Policy, Operations and Legislation Committee meeting on 14 July 2021.

    An item related to this project will be considered by Committee on Wednesday 9 June 2021.

    The proposed local law is being recommended for adoption, including a number of changes made as a result of community and State government feedback.


    PROPOSED CHANGES

    61 submissions were received during the comment period. The two main themes raised by respondents were concerns with the changes to parking on verges, and concerns with pay-by-phone only payment options.

    An amendment has been proposed which would allow owners/occupiers of the premises adjacent to the verge (or an authorised person) to park a vehicle on the verge, but excludes 'long and heavy vehicles' such as buses and verge parking adjacent to grouped dwellings such as apartments.

    Other amendments have also been suggested in response to comments from the Department of Local Government, Sport and Cultural Industries, including the addition of provisions for special event parking and for urgent, essential or official functions.
