We’re seeking your feedback on proposed updates to some provisions in the City of Fremantle Property Amendment Local Law 2020, including a provision to enable the City to make a determination controlling smoking in specific areas of local government property.


What updates are proposed and why?

Some key changes proposed are controlling smoking on local government property (see section 2.8) and penalties for 'taking or injuring fauna' and 'removing or damaging any flora' (see section 4.3).

A key focus of the City of Fremantle is creating a physical and social environment where it is easy for people to lead safe, happy and healthy lives, with 'environments that promote healthier lifestyles and community enjoyment' an outcome in our Strategic Community Plan. To ensure the City's property is available to be used for social activities for all, it is considered desirable to be able to designate certain areas of local government property as smoke free areas. It is anticipated that smoke free areas will improve the amenity in Fremantle by reducing litter from cigarette butts as well as exposure to cigarette smoke by users of local government property. Therefore, the City is proposing updates to the Local Government Property Amendment Local Law 2020 to enable this.


Purpose and Effect

The purpose and effect of the City of Fremantle Local Government Property Amendment Local Law 2020 is as follows:

Purpose - To provide for the regulation, control and management of activities and facilities on all local government property within the district.

Effect - To establish the requirements with which any person using or being on all local government property within the district, must comply.

  • Property Amendment Local Law Adopted

    At the Ordinary Council meeting of 27 January 2021, Council resolved to adopt the Property Amendment Local Law 2021 after the Committee recommended it for approval at the Finance, Policy, Operations and Legislation Committee meeting of 20 January 2021.     The local law will be advertised in the Government Gazette on 12 February 2021 and will come into effect 14 days after its publication.

    The amendment will be incorporated into the City of Fremantle Property Local Law 2002 after this date, click here to view the consolidated local law on the City's website.
