19F Lefroy Road Right of Way Upgrade and Dedication
The City is seeking comments on a proposal to upgrade and dedicate the Right of Way at 19F Lefroy Road, South Fremantle, and fund such an upgrade through the imposition of a temporary new rate on adjoining properties.
At the 13 August 2025 Ordinary Council Meeting the Council considered a request for the upgrade and dedication of the Right of Way at 19F Lefroy Road, South Fremantle. Council resolved to support the proposal for the purpose of community consultation. The proposal relates to the location in red below:
In summary
The City has received a request for the upgrade of the private Right of Way (ROW) at 19F Lefroy Road and subsequent dedication as a public road. The ROW provides vehicle and pedestrian access between Lefroy Road and Jenkin Street. The dedication of a private ROW effectively transfers the land from private ownership to a public road under the care and control of the City. This allows for coordinated maintenance and management of the road, infrastructure and services as well as providing the ability for subdivision of lots which can utilise the ROW as a primary frontage. In accordance with the Council Policy - Policy and procedures for the dedication, upgrade or closure of rights of ways, prior to Council providing support for the dedication of a ROW it is to be upgraded. Upgrades to the laneway include drainage, kerb installation, resurfacing and the installation of lighting.
In order to fund this upgrade Council may resolve to impose a Specified Area Rate (SAR). The Local Government Act 1995 specifies:
A local government may impose a specified area rate on rateable land within a portion of its district for the purpose of meeting the cost of the provision by it of a specific work, service or facility if the local government considers that the ratepayers or residents within that area —
- (a) have benefited or will benefit from; or
- (b) have access to or will have access to; or
- (c) have contributed or will contribute to the need for, that work, service or facility.

At this time the City is seeking a response from all adjoining landowners in order to determine the level of commitment to a Specified Area Rate prior to proceeding.
Before the Council makes a final decision, we are asking adjoining landowners to:
- Review the Key Documents.
- Contribute feedback by completing the survey or provide a written submission
- RSVP to attend the information session or request a 1:1 meeting with a City Officer.
City Officers aim to:
- Keep you informed, listen to and acknowledge concerns and provide feedback on how public input influenced the decision.
- Work with you to ensure that your concerns and aspirations are put forward to Council and provide feedback on how public input influenced the decision.
