We're proposing amendments to the City of Fremantle Local Planning Scheme No. 4 (LPS4) to maintain its currency.


In September 2020 Council resolved to amend the land uses definitions, car parking requirements, and land use permissibility within the City’s Local Planning Scheme No. 4 (LPS4). The changes mainly seek to align the land use definitions within the City’s Scheme to those within the Model Scheme Text, and include new land use permissibility and vehicle parking requirements for newly created definitions, as well as amendments to some existing land uses.


Proposed Amendments

The proposed amendments are:

  1. Adding definitions from the Model Scheme Text that are not currently in LPS4.
  2. Replacing definitions within LPS4 with Model Scheme Text definitions.
  3. Deleting definitions within LPS4 that are surplus to requirements or are suitably replaced by another.
  4. Adding definitions that are not within the Model Scheme Text.
  5. Adding land use permissibility and vehicle parking requirements for the proposed land uses.
  6. Modifying existing land use permissibility for the existing land uses of Reception Centre, Restaurant, and Grouped Dwellings.
  7. Adding a provision regarding non-residential development on land zoned Residential.


Proposed Additions

The proposal includes two new land uses (and permissibility) that are not in the Model Scheme Text but that the City considers advantageous to have in the interest of regulating future proposals. The land uses and their definition are:

  • Drive-through food outlet: means a fast food outlet/lunch bar which includes the sale and serving of food direct to persons driving or seated in motor vehicles.
  • Large format digital signage: means an electronic billboard whether freestanding or attached to another structure, and with a display area of greater than 13sqm.

The amendment also includes the addition of the following provision:

  • Unless otherwise provided for in the scheme, development on land zoned Residential is to comply with the Residential Design Codes.

The above provision is intended to capture non-residential development where such uses are permitted in Residential zones, to maintain the expected amenity of residential zones.

    The amendment was finalised and published in the Government Gazette on 29 July 2022. The Local Planning Scheme has been updated to reflect the changes and can be found here.

    The amendment was considered by the Strategic Planning and Transport Committee on Wednesday 17 March 2021.

    Committee noted the submission and recommended that the amendment be approved and referred to the Western Australian Planning Commission for final approval by the Minister for Planning.

    The report recommends that Council approve the proposal and refer it to the Western Australian Planning Commission with a recommendation for final approval by the Minister for Planning.
