The City of Fremantle has initiated Local Planning Scheme Amendment No. 81 to allow for 'additional uses' to an existing residential dwelling located at No. 59 Ellen Street, Fremantle.

This property was previously used as a medical practice (Ellen Health) until the business vacated the premises some years ago. Due to the ‘Residential’ zoning of the land, the continued use of the property for a medical consulting purpose (or similar use) is currently prohibited under the planning scheme.

The City has received a request to establish a ‘veterinary hospital’ on the site; a land-use which is also not permitted under the current zoning. The business proposed would involve retaining the existing heritage-listed building and car parking on the site in order to operate a veterinary hospital from the property.

An amendment to the planning scheme for this property has been initiated by Council. This change would involve amending the planning scheme to allow for ‘additional’ land-uses of 'veterinary hospital', 'veterinary clinic', 'consulting rooms' and 'medical centre' without changing the existing ‘Residential’ zoning.

As part of the scheme amendment, it is proposed to include a condition restricting the number of aminals which are permitted to be hospitalised overnight to ten (10). Refer to the Council reports in the Document Library for further information.

    On 5 May 2020, Scheme Amendment No. 81 was published in the State Government Gazette after being formally approved by the Minister for Planning. This means that the amendment now forms part of the City of Fremantle planning scheme.     On 26 February 2020, the City of Fremantle Council gave its final approval to Scheme Amendment No. 81 by voting to support the amendment.

    The amendment will now be sent to the Western Australian Planning Commission (WAPC) who will make a final recommendation on the proposal to the Minister for Planning. If approved by the Minister, the amendment will be published in the Government Gazette and will then form part of the City’s Local Planning Scheme.

    An item relating to the proposal will be considered by the Strategic Planning & Transport Committee on Wednesday 12 February 2020 and then at the Ordinary Meeting of Council on Wednesday 26 February 2020. Both meetings commence at the North Fremantle Community Hall, located at 2 Thompson Road, North Fremantle at 6.00pm, and are open to the public.

    A copy of the Council report will be made available on the Agendas and Minutes page of the City's website, the Friday before each meeting.

    At the Strategic Planning and Transport Committee held on Wednesday 20 November 2019, Council resolved to initiate a formal amendment to the planning scheme on the above-mentioned property.

    This scheme amendment (officially referred to as Amendment No. 81) would allow for additional land uses on the site of Veterinary Clinic, Veterinary Hospital, Consulting Rooms, or Medical Centre.

    At the Strategic Planning and Transport meeting held on 21 August 2019, it was resolved to commence preliminary community consultation on the idea of introducing additional uses to the subject property.

    This consultation runs for 28 days, from Friday 13 September 2019 and will conclude at 5pm on Friday 11 October 2019.
