Local Planning Policy 3.1.3.1 - WAPC Approval
The Western Australian Planning Commission (WAPC) have approved the accompanying Local Planning Policy 3.1.3.1. In approving the policy, the WAPC resolved to remove a clause recommended by Council relating to overshadowing not exceeding 25 percent of the neighbouring site. Their reasoning for removing the specific shadowing requirement was as follows:
- There is no specific need in the locality for the default Residential Design Codes (R-Codes) provisions to be varied;
- The solar access (i.e. overshadowing) provision is onerous for an R-AC3 coded site; and
- Site-specific development controls within the existing statutory frameworks adequately address solar access provisions.
The modified policy now forms part of the City’s planning policy manual and can be viewed on the City’s website.
