Amendment No. 77 Gazetted
The Minister for Planning has approved Planning Scheme Amendment No. 77. The amendment was gazetted on 13 November 2020, and now forms part of the City of Fremantle’s Local Planning Scheme No. 4.
The amendment re-zones Nos. 7 & 9-15 Quarry Street, Fremantle, to ‘Mixed Use’ with a residential density of R80 (i.e. medium density). These lots were previously zoned a combination of ‘Residential R25’ and ‘Mixed-Use R-AC3’. The amendment also incorporates some specific development requirements for the site into Schedule 7 of the Planning Scheme (e.g. building height and boundary setbacks).
As part of the Minister’s approval, some changes were made to the final amendment. The most notable change was to specify that building heights should be as per the Residential Design Codes of Western Australia (R-Codes), rather than the maximum 3 storeys and 12m proposed by Council. However, the requirement that buildings be limited to 6m max. wall height and 9m max. overall height within 10m of the neighbouring north-eastern and south-western boundaries has been retained. The R-Codes specify a default 4 storey height limit for multiple dwellings (apartments) in R80 coded areas.
The City is still waiting for a decision from the WAPC on the draft local planning policy 3.1.3.1. This page will be updated with further details on the status of the policy as they come to hand.
