We’re proposing to make a Waste Local Law and we’re seeking your feedback.

The City currently relies on limited waste‑related provisions contained in the City’s Health Local Laws 1997 to administer and manage waste services in the City.

The development of a Waste Local Law is identified as a future action in the City’s 2025–2030 Waste Management Action Plan. The Local Law will support the City in implementing the State Government’s Waste Strategy and assist in achieving established waste targets.

The purpose of the proposed Waste Local Law are as follows:

1. Regulate the provision and use of Local Law Government waste services

2. Support waste avoidance, recycling, and resource recovery

3. Protect public health, safety and amenity

4. Provide clear duties and responsibilities

5. Enable effective operations and protection of waste facilities

6. Establish a clear and enforceable compliance framework

The proposed City of Fremantle draft Waste Local Law 2026 is based on WALGA’s model local law template with no modifications, used by many other local governments across the metropolitan area.

Public Notice

In accordance with section 3.12 of the Local Government Act 1995, the City of Fremantle gives public notice of its intent to make the City of Fremantle Waste Local Law 2026. The purpose and effect of this local law is:

Purpose: To assist the City of Fremantle in administering waste and recycling services to maintain consistent, cost effective and functional waste management practices.
Effect: Establish the requirements with which any owner or occupier of premises using local government waste services, including the use of receptacles for the deposit and collection of waste within the district.

Following adoption by Council, the abovementioned local law will come into operation 14 days after publication in the Government Gazette. Copies are available to view below, online, and in hard copy at the Walyalup Civic Centre.

Submit Your Feedback
The City of Fremantle invite public submissions. Your feedback will be reviewed and presented to Council when considering if the local law is to be adopted.

We are asking the public to:

  • Review the draft Waste Local Law via the Key Documents and Frequently Asked Questions.
  • Share feedback via the Survey on this project page.

Please note, 1:1 meeting requests are subject to staff availability and scheduling. Group meetings will be capped to 10 people at a time.
